Terms and conditions
1. Object
These general conditions of sale apply to all sales made by the company ARS ESSENTIA with a capital of € 10,000, whose head office is located at 9 place Felix Ziem 21200 Beaune, and registered in the Trade and Companies Register of DIJON under the number 851 961 003.
They can be viewed on the online sales website called “www.arsessentia.com” before the actual purchase of the goods, subject of the order.
The specific terms provided below are however applicable only to “consumers” or only to “non-professional buyers”, together referred to as “Customer (s)”.
2- Order
All prices are expressed in Euro, excluding delivery costs and all taxes included.
The customer declares to have fully read and accepted these General Conditions of Sale by checking the box "I accept the general conditions of sale", before proceeding to secure payment.
The final validation of the order by the customer will constitute proof of the order and the payment of amounts for the products selected in the order. This validation constitutes signature and acceptance of all operations carried out on the site www.arsessentia.com.
3- payment
The total price indicated during the final validation of the order includes the price of the purchase, packaging and delivery.
We indicate to our customers that the delivery costs cannot constitute a valid reason for questioning the order after its final registration.
The buyer can pay either by bank transfer or by credit card via the secure site according to the conditions sent by e-mail at the end of the order.
A refusal of authorization by the banking center entails the automatic cancellation and without compensation of the order. If an incident occurs during the registration of the order, it is null and void and the customer must repeat the ordering procedure. The order is taken into account for payment which is stipulated irrevocable, cash, net and without discount.
ARS ESSENTIA reserves the right to suspend any order management and any delivery in the event of refusal of authorization of payment by bank card from officially accredited bodies or in the event of non-payment. The company ARS ESSENTIA reserves the right in particular to refuse to make a delivery or to honor an order from a customer who has not fully or partially paid a previous order or with whom a payment dispute is in progress. .
4- Withdrawal, exchange and refund
the consumer has, in accordance with the provisions of article L 221-18 of the Consumer Code, a withdrawal period of 14 days from the actual delivery of the goods to make known by registered mail with acknowledgment of receipt his decision withdrawal by sending to the following address: Galerie ARS ESSENTIA, 9 place Felix Ziem 21200 Beaune, a declaration expressing unequivocally its desire to withdraw.
The items must be returned to ARS ESSENTIA in their original packaging, in perfect condition, without trace of use and in accordance with the description issued by ARS ESSENTIA on delivery, without excessive delay and at the latest 14 days after the consumer has communicated to ARS ESSENTIA its wish to withdraw.
The return costs will be the sole and final responsibility of the consumer. The return of the items must be accompanied by the invoice, and carried out under the same security conditions as the shipment.
The risks relating to the return of a work or any other items sold on the site www.arsessentia.com are the sole responsibility of the customer who must ensure that risks are covered by his carrier.
The reimbursement of items returned by the consumer within the time limits, will be made by the means of payment left to the choice of the company ARS ESSENTIA that the consumer already undertakes not to dispute. The refund of the item (s) will be made within 14 days of receipt by ARS ESSENTIA of the returned items. It is specified that the shipping costs of the order of (s) (the) article (s) are not reimbursed.
5- Transfer of ownership - Transfer of risk - Delivery
The transfer of ownership of the articles will only be carried out after full payment of the price by the customer, regardless of the delivery date of said articles. In addition, the risk of loss and damage to the items ordered is transferred to the consumer when the latter or a third party designated by him, and other than the carrier offered by ARS ESSENTIA, takes physical possession of these goods.
Orders are processed as quickly as possible. The actual delivery, however, depends on the preparation time of the packages and the delivery time. The items purchased by the customer will be delivered in mainland France by the postal services or by carrier within a maximum period of 30 days to the address indicated by the customer when ordering.
ARS ESSENTIA undertakes to make its best efforts to deliver the products ordered by the customer within the deadlines specified above.
However, these deadlines are communicated for information only and any overrun may not give rise to any damage and interest, withholding or cancellation of the order by the customer.
However for consumers, if the products ordered have not been delivered after the indicative delivery date, for any reason other than force majeure, the sale may be resolved at the written request of the consumer, sent by registered letter with acknowledgment of receipt if it was preceded by the sending by the consumer of a formal notice to deliver the order with a reasonable time limit not respected by ARS ESSENTIA. The sums paid by the consumer will then be returned to him without delay and no later than 14 days after receipt of the letter of resolution of the sale, to the exclusion of any compensation or withholding.
6- Receipt of the order
Only the carrier is responsible for any degradation and / or loss of item (s) relating to its (their) delivery. The company ARS ESSENTIA cannot be held responsible for the shortcomings of the carrier, nor substitute for the latter.
For this, the customer is reminded that upon receipt of the order the buyer must check the good condition of the goods. If the customer finds that the package or its contents have been damaged in any way whatsoever (package pierced, open, or damaged, product missing, damaged or broken), he must refuse the package and note a reservation on the delivery slip. delivery. The customer must then formulate a reasoned complaint to the carrier within 48 hours of delivery and by registered letter with acknowledgment of receipt. 7- Intellectual property rights
The artist behind a work still owns the copyright to its creation. The client's rights to the work are therefore limited to strictly private use.
Any reproduction, representation, distribution, even partial, of a work without the prior and specific authorization of the author is strictly prohibited and punishable on both civil and criminal grounds for infringement.
Likewise, all content of the site www.arsessentia.com, (photos, texts, etc.), remains the entire property of the company ARS ESSENTIA.
8- Safety and responsibility
The articles sold on the site www.arsessentia.com are intended for decoration as works of art made by artists.
Any item sold on the site www.arsessentia.com is not a toy, and should only be handled by children in the presence of a responsible adult person.
The customer therefore declares himself fully informed of the risks and the responsibility of the company ARS ESSENTIA can not be engaged for any use of its articles outside the purely decorative framework.
ARS ESSENTIA hereby expressly informs the customer that the Internet is not a secure network. Under these conditions, it is the customer's responsibility to take all appropriate measures to protect their own data and / or software, in particular from contamination by any viruses circulating on the Internet network or from the intrusion of a third party into the system of his terminal (laptop, personal assistant or mobile) for any purpose whatsoever.

10- Duration of these GTC
These conditions apply to the services offered by the company ARS ESSENTIA. They can be modified at any time by ARS ESSENTIA. The applicable conditions are those in force on the date of registration of the order.
11- Territoriality and applicable law
Sales of works and articles of the company ARS ESSENTIA are subject to French law. Any dispute is submitted to the competent court within the jurisdiction of the Dijon Court of Appeal.
It is specified that our services are open to persons having the legal capacity to contract under the applicable law. In particular, minors are not authorized to have access to our online sales services. Only the French text of these conditions of sale will prevail. Translations into other languages are for information only. If a provision hereof is considered null by a competent court, this nullity will not affect the other provisions which will retain all their effects. Failure to exercise a right recognized herein does not constitute a waiver thereof.
12- Acceptance
